On October 18, 2017, the Court of Criminal Appeals has stayed Clinton’s execution and remanded the case back to the Midland District Court.

The reason for staying Clinton’s execution is the possible false testimony of co-defendant David Page during Clinton’s trial in 2003. The trial court now has to conduct further fact finding in order to determine whether Clinton received a fair trial.
